That shift fork looks a bit used! It could possible be a worn sncro or corresponding gear. The tapper will get work and not catch the gear. That would cause it not to shift into gear, which leaves that worn shift fork.
Since I am not massively familiar with those transmissions I can't say with any certainty, but the teeth look decent enough… The sad thing is the people who got the trans from vwdarrin COULD have swapped the guts from that trans before they returned it to him. Not saying that they did, but it is a possibility if everything else is eliminated, just saying it's possible. Damn shame in any case.
If the trans is popping out of first and third then it is not the fault of that fork. That fork engages first and second and another fork engages third and fourth. Two entirely different forks. Seems like something is preventing these two forks from fully engaging first and third gear, such as something external. Think about this, each fork must be moved in the same direction to engage first and third.

Make sure the shifter cable is free andnot binding. My dad worked for Avco Lycoming as a gear maker ,made a third gear for my go-cart tranny

To check if it is the box or not have you tried putting it into first, disconnecting the shift linkage and then driving? Does it pop out of gear then?

Been there done that. You really need s good service manual that gives the specs.
